La medida suena bien. Y lo es, dentro de sus l\u00edmites. El problema es lo que queda fuera.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El gobierno federal anunci\u00f3 en mayo un paquete de reformas que incluye sanciones m\u00e1s duras para consultores que cometan fraude o den asesoramiento enga\u00f1oso, mayor transparencia en el registro p\u00fablico de profesionales habilitados y, por primera vez, un mecanismo de compensaci\u00f3n directa para quienes perdieron dinero por la mala conducta de un consultor con licencia.<\/span><\/p>\n<h2><b>\u00bfQu\u00e9 cubre el fondo y qu\u00e9 no?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">El fondo tiene aplicaci\u00f3n retroactiva hasta noviembre de 2021, lo cual ampl\u00eda bastante el universo de posibles reclamantes. Si alguien pag\u00f3 a un consultor registrado y ese profesional fabric\u00f3 documentos, dio informaci\u00f3n falsa o desapareci\u00f3 con el dinero, hay un camino formal para pedir la devoluci\u00f3n.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Lo que no cubre es exactamente lo que m\u00e1s da\u00f1o hace: los llamados ghost consultants. Son personas que operan sin licencia, muchas veces desde fuera de Canad\u00e1, y que cobran miles de d\u00f3lares por servicios que no existen. Prometen residencias permanentes que no pueden tramitar, inventan programas migratorios ficticios y, cuando algo sale mal, simplemente cambian de nombre o de n\u00famero de tel\u00e9fono.<\/span><\/p>\n<h2><b>\u00bfPor qu\u00e9 importa esto para la comunidad latina?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">En las oficinas de abogados de inmigraci\u00f3n de Toronto, el patr\u00f3n se repite con una frecuencia que ya dej\u00f3 de sorprender. Familias colombianas, mexicanas, venezolanas y ecuatorianas que pagaron entre cinco mil y quince mil d\u00f3lares a alguien que encontraron por redes sociales o por recomendaci\u00f3n de un conocido, y que terminaron con solicitudes rechazadas, documentos falsificados a su nombre o, peor a\u00fan, prohibiciones de entrada al pa\u00eds.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El caso m\u00e1s com\u00fan es el del consultor fantasma que opera desde Am\u00e9rica Latina y ofrece paquetes completos de inmigraci\u00f3n a Canad\u00e1 por WhatsApp. Cobra por adelantado, env\u00eda recibos que parecen oficiales y, en algunos casos, llega a presentar solicitudes ante IRCC con informaci\u00f3n inventada. Cuando la solicitud es rechazada, la v\u00edctima no solo pierde el dinero: queda con un antecedente de misrepresentation que puede cerrarle las puertas durante cinco a\u00f1os.<\/span><\/p>\n<h2><b>\u00bfC\u00f3mo protegerse?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Verificar si un consultor tiene licencia activa se puede hacer en minutos en el sitio web del College of Immigration and Citizenship Consultants. Si no aparece en el registro, no importa cu\u00e1ntas promesas haga ni cu\u00e1ntos testimonios publique en Instagram: no est\u00e1 autorizado.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Las reformas de julio tambi\u00e9n exigen que, a partir de abril de 2027, el registro p\u00fablico incluya m\u00e1s informaci\u00f3n sobre cada consultor: nombre comercial, ubicaci\u00f3n, estado de la licencia, condiciones y cualquier medida disciplinaria. Es un avance.
