Este fallo, emitido por unanimidad, reabre un cap\u00edtulo clave en la b\u00fasqueda de justicia por uno de los peores ataques terroristas en la historia del pa\u00eds.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El tribunal desestim\u00f3 los recursos presentados por las defensas de Fern\u00e1ndez y otros exfuncionarios, ratificando la decisi\u00f3n de la C\u00e1mara Federal de Casaci\u00f3n Penal de revertir los sobreseimientos dictados en 2021. Seg\u00fan la denuncia original del fiscal Alberto Nisman, el Memor\u00e1ndum de Entendimiento firmado con Ir\u00e1n en 2013 buscaba encubrir a funcionarios iran\u00edes se\u00f1alados como responsables del ataque, que dej\u00f3 85 muertos y m\u00e1s de 300 heridos.<\/span><\/p>\n<h2><b>El Memor\u00e1ndum con Ir\u00e1n<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">El pol\u00e9mico tratado, aprobado por el Congreso pero declarado inconstitucional en 2014, propon\u00eda interrogar a los sospechosos iran\u00edes fuera del pa\u00eds. Sin embargo, nunca se implement\u00f3, y la hip\u00f3tesis de la fiscal\u00eda sostiene que el acuerdo persegu\u00eda otorgar impunidad a los acusados mediante negociaciones al margen de los canales institucionales.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La causa, archivada en 2021 tras considerarse un acto de pol\u00edtica exterior no judicializable, fue reabierta en 2023. Seg\u00fan el fallo de la Corte, no hubo arbitrariedad ni gravedad institucional en esta reapertura, habilitando el juicio oral que involucrar\u00e1 a la expresidenta y otros exfuncionarios.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El fiscal Alberto Nisman denunci\u00f3 a Fern\u00e1ndez en enero de 2015, alegando que su gobierno buscaba proteger a los acusados iran\u00edes a cambio de beneficios comerciales. Un d\u00eda antes de presentar pruebas, Nisman fue encontrado muerto en su departamento en circunstancias que a\u00fan generan controversia. Inicialmente considerado un suicidio, el caso fue posteriormente investigado como un posible homicidio, sin que se haya identificado a los responsables. La denuncia de Nisman reaviv\u00f3 el debate sobre la conexi\u00f3n entre el atentado a la AMIA y los intereses geopol\u00edticos en torno a Ir\u00e1n.<\/span><\/p>\n<h2><b>Causa \u00abD\u00f3lar Futuro\u00bb: Fern\u00e1ndez sobrese\u00edda<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">En otro fallo, la Corte Suprema confirm\u00f3 el sobreseimiento de Cristina Fern\u00e1ndez en la causa \u00abD\u00f3lar Futuro\u00bb, donde se investigaban presuntas irregularidades en la venta anticipada de d\u00f3lares por parte del Banco Central en 2015. La C\u00e1mara Federal de Casaci\u00f3n Penal determin\u00f3 que las operaciones investigadas no constituyeron un delito, ya que respond\u00edan a decisiones de pol\u00edtica econ\u00f3mica y no implicaron perjuicio comprobado para las arcas p\u00fablicas.
