Sin embargo, el Comit\u00e9 de la ONU se\u00f1al\u00f3 que estas medidas, en lugar de ser excepcionales, se est\u00e1n normalizando, situaci\u00f3n que calificaron de \u00abalarmante\u00bb. Particularmente, el Comit\u00e9 cuestion\u00f3 la declaraci\u00f3n de \u00abconflicto armado interno\u00bb por parte del presidente Daniel Noboa, la cual ha sido utilizada para justificar suspensiones de derechos fundamentales como la libertad de movimiento, asociaci\u00f3n y reuni\u00f3n.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El organismo internacional subray\u00f3 que estas restricciones afectan de forma desproporcionada a grupos vulnerables, como los pueblos ind\u00edgenas, personas en situaci\u00f3n de pobreza y solicitantes de asilo. En su informe, la ONU recomend\u00f3 al gobierno ecuatoriano limitar el uso de estados de excepci\u00f3n, asegurando que sean temporales, necesarios y sujetos a revisi\u00f3n judicial.<\/span><\/p>\n<h2><b>Corrupci\u00f3n en el sistema judicial<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">La ONU tambi\u00e9n resalt\u00f3 la corrupci\u00f3n dentro del sistema judicial de Ecuador como una barrera significativa para la justicia. Aunque reconoci\u00f3 los esfuerzos para fortalecer las unidades judiciales que abordan delitos de corrupci\u00f3n y crimen organizado, el Comit\u00e9 expres\u00f3 su preocupaci\u00f3n ante denuncias de sobornos, procesos judiciales retrasados y beneficios penitenciarios otorgados a miembros de organizaciones criminales.<\/span><\/p>\n<h2><b>Crisis en el sistema penitenciario<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">El informe de la ONU tambi\u00e9n abord\u00f3 la grave crisis en el sistema penitenciario de Ecuador, se\u00f1alando que la militarizaci\u00f3n y la infiltraci\u00f3n del crimen organizado obstaculizan el funcionamiento adecuado de las c\u00e1rceles. El Comit\u00e9 pidi\u00f3 reducir el hacinamiento y limitar el uso de la prisi\u00f3n preventiva para mejorar las condiciones dentro de los centros penitenciarios.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En respuesta a estas preocupaciones, el presidente Noboa anunci\u00f3 una reforma constitucional que pretende excluir a las personas privadas de libertad de los grupos de atenci\u00f3n prioritaria. Seg\u00fan Noboa, los recursos p\u00fablicos deben enfocarse en quienes \u201clo necesitan y lo merecen\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La ONU inst\u00f3 a Ecuador a capacitar a jueces y fiscales en el combate a la corrupci\u00f3n, as\u00ed como a implementar medidas de seguridad para que el personal judicial pueda trabajar sin interferencias ni amenazas.
