El Bill C-12, conocido formalmente como la Ley para Fortalecer el Sistema de Inmigraci\u00f3n y las Fronteras de Canad\u00e1, elimin\u00f3 el acceso al Tribunal de Inmigraci\u00f3n y Refugiados para quienes esperaron m\u00e1s de un a\u00f1o antes de solicitar asilo. Las cartas de deportaci\u00f3n comenzaron a circular d\u00edas despu\u00e9s de que la ley recibiera sanci\u00f3n real, y el impacto en las comunidades inmigrantes del pa\u00eds ha sido inmediato.<\/span><\/p>\n<h2><b>\u00bfQui\u00e9nes son los afectados?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">La norma aplica a todas las personas que ingresaron a Canad\u00e1 despu\u00e9s del 24 de junio de 2020 y que presentaron su solicitud de refugio m\u00e1s de un a\u00f1o despu\u00e9s de haber cruzado la frontera. Se estima que hasta 30,000 personas podr\u00edan quedar dentro de este rango. Para muchas de ellas, Canad\u00e1 ya es todo: tienen empleo estable, hijos inscritos en escuelas canadienses y redes de apoyo construidas durante a\u00f1os. Ahora enfrentan la posibilidad real de ser expulsadas sin que ning\u00fan tribunal independiente haya escuchado su caso.<\/span><\/p>\n<h2><b>\u00bfQu\u00e9 dice exactamente la carta que est\u00e1n llegando?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">El Ministerio de Inmigraci\u00f3n, Refugiados y Ciudadan\u00eda de Canad\u00e1 (IRCC) comenz\u00f3 a enviar notificaciones formales informando a estas personas que su solicitud ya no ser\u00e1 remitida al IRB. El tribunal que normalmente eval\u00faa los pedidos de refugio y que est\u00e1n sujetas a un proceso acelerado de remoci\u00f3n. La carta no es una orden de deportaci\u00f3n inmediata, pero es el primer paso de ese camino. A partir de ese momento, la \u00fanica opci\u00f3n que la ley les ofrece es una evaluaci\u00f3n de riesgo previo a la remoci\u00f3n, conocida como PRRA, que los defensores de derechos migratorios califican como un mecanismo con garant\u00edas insuficientes.<\/span><\/p>\n<h2><b>\u00bfQu\u00e9 diferencia hay entre el PRRA y una audiencia formal?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">En una audiencia ante el IRB, una persona puede presentar evidencia, llamar testigos y ser representada por un abogado frente a un juez especializado en derecho de refugio. El proceso fue dise\u00f1ado para proteger a personas en situaci\u00f3n de vulnerabilidad real. El PRRA, en cambio, es una evaluaci\u00f3n escrita realizada por un funcionario del mismo ministerio que orden\u00f3 la deportaci\u00f3n. No hay audiencia oral, no hay posibilidad de interrogar a la contraparte, y el porcentaje de casos aprobados a trav\u00e9s de este mecanismo ha sido hist\u00f3ricamente muy bajo. Para los abogados de inmigraci\u00f3n, esa diferencia no es menor: es la diferencia entre una protecci\u00f3n real y una formalidad.<\/span><\/p>\n<h2><b>\u00bfQu\u00e9 justific\u00f3 el gobierno para aprobar esta ley?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">El primer ministro Mark Carney argument\u00f3 que el sistema de asilo canadiense llevaba a\u00f1os al borde del colapso. Los tiempos de espera para una audiencia ante el IRB llegaban a superar los cinco o seis a\u00f1os en muchos casos, lo que generaba un represamiento que afectaba tanto a quienes presentaban solicitudes genuinas como a la capacidad operativa del tribunal.
