Mientras tanto, quienes recibieron cartas de deportaci\u00f3n viven en un estado de incertidumbre que los abogados de inmigraci\u00f3n no dudan en calificar como \u00abp\u00e1nico masivo\u00bb.<\/span><\/p>\n<h2><b>\u00bfQu\u00e9 dicen los demandantes?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Las organizaciones y abogados que presentaron los casos argumentan que el Bill C-12 viola la Carta Canadiense de Derechos y Libertades. El n\u00facleo del argumento es que privar a una persona del derecho a una audiencia ante un tribunal independiente, donde pueda demostrar que su vida est\u00e1 en riesgo si es deportada. En la pr\u00e1ctica, esto no suspende autom\u00e1ticamente las deportaciones individuales. Cada persona afectada debe presentar su propia demanda y solicitar medidas cautelares para frenar su remoci\u00f3n, pero s\u00ed se\u00f1ala que la Corte est\u00e1 tomando el asunto con seriedad y que los casos ser\u00e1n resueltos con mayor coherencia jur\u00eddica.<\/span><\/p>\n<h2><b>\u00bfQu\u00e9 pasa con quienes no presentan una demanda?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Los abogados de inmigraci\u00f3n advierten que las personas que recibieron una carta de IRCC y no toman acci\u00f3n legal en un plazo razonable corren el riesgo de quedar incluidas en una lista de deportaciones sin mayor tr\u00e1mite. El proceso puede avanzar con rapidez una vez que se fija una fecha de remoci\u00f3n, y el margen para reaccionar suele ser estrecho. La recomendaci\u00f3n un\u00e1nime entre los especialistas es buscar asesor\u00eda legal de inmediato, preferiblemente a trav\u00e9s de una cl\u00ednica legal gratuita o una organizaci\u00f3n de apoyo a migrantes.
